Mr Jide Lanlehin was instructed on an appeal against sentence of 12 months imprisonment for possession of a false French Passport with intent passed by at Croydon Crown Court by way of leave of single judge.
The Court of Appeal led by Lady Justice Sharp quashed the sentence of 12 months and replaced it with a sentence of 6 months imprisonment.
The Court was of the view that although the appellant had entered the UK with a false passport. this was not the same passport that he used to obtain employment. He was before the court to be sentenced for using a false passport to obtain employment. The case of Kolawole distinguished from this matter. There was substantial mitigation in this case to warrant a reduced sentence in line with the case Ovieratchki.
