Vishal Misra, instructed by Taylor Rose MW, secured the acquittal of his client for 3 counts of assaulting an emergency worker after a successful submission of no case to answer on all counts at Croydon Crown Court.
The defendant was accused of hitting two police officers and biting a third. Vishal relied upon the body worn footage of officers during cross examination, leading witnesses to concede that the defendant could not been seen hitting anyone. Vishal also highlighted the dynamic and fast paced nature of the incident, leading an officer to concede that it was possible that the defendant had not bitten him at all.
Vishal successfully submitted that the evidence supported the view that the defendant never made a positive act either intentionally or recklessly that could amount to an assault. Not Guilty verdicts were recorded.
