DOMESTIC AND INTERNATIONAL RESTRAINT AND ASSET CONFISCATION ORDERS, SEARCH WARRANTS AND PRODUCTION ORDERS
Members of Chambers advise on and conduct restraint, receivership, confiscation, and disclosure order proceedings in the Crown Court and High Court; Parts 2 and 5 of the Proceeds of Crime Act 2002. We represent authorities, defendants, and affected third parties in cases brought by the Serious Fraud Office, Crown Prosecution Service, police forces and the National Crime Agency. We advise and represent defendants and authorities in relation to the detention and forfeiture of seized cash.
We have a particular expertise, and dozens of reported cases, in High Court challenges to search warrants, notices to produce, and production orders, under the Protection of Children Act 1978, the Police and Criminal Evidence Act 1984, the Criminal Justice Act 1987, the Proceeds of Crime Act 2002, the Extradition Act 2003, the Crime (International Co-operation) Act 2003, and the Serious and Organised Crime and Police Act 2005.
We have also been involved in many reported cases, in London and abroad, relating to the use of these statutes in aid of foreign prosecutions and cross-border investigations. We are currently developing particular expertise in these areas in West Africa.
