Clarissa Rodio, instructed by SBG Solicitors, secured the discharge of her client’s extradition to Poland on the basis that it would be a disproportionate interference with his Article 8 rights.
The Requested Person was sought by the Polish authorities pursuant to two conviction warrants for three offences of robbery that took place some 14 years ago when he was aged 19 years old. The factors militating against extradition encompassed, inter alia, severe hardship to the Requested Person’s family suffering from serious mental health issues, the long delay involved and other factors in respect of his family and private life which are sufficiently strong to counterbalance the fact of his fugitive status.
The warrant was discharged.
