Chengetai Mupara, instructed under the Public Access Scheme, was successful in a human rights appeal by a Zimbabwean national.
The client’s husband died in the UK in 2018 and was buried in Liverpool. In 2019, the client applied to enter the UK for the purposes of holding a memorial service one year after the death in line with Zimbabwean custom and tradition. She also intended to visited her grown up children and grandchildren who live in the UK. Her visa application was refused and she appealed. Chengetai successfully argued that bereavement engaged private and family life and it would be a disproportionate interference with family to refuse entry. The appeal was allowed immediately.
