Jeanette Stevenson, instructed by Blackfields Solicitors, assists her client, an interested person joined to the confiscation proceedings, to save her family home.
The defendant, the ex-partner of the client, was recently convicted of possession with intent to supply class A and had received a lengthy custodial sentence. The Crown were seeking to confiscate his equity in the house he jointly owned with Miss Stevenson’s client.
The client’s world had been turned upside down following her ex’s conviction and had consequently become a single parent facing the possibility of having the family home she lived in with her small children confiscated and sold under the Proceeds of Crime Act.
Miss Stevenson was able to obtain settlement with the Crown that the defendant only held a 30% interest in the family home and her client being entitled to 70%.
This result meant that the client was able to raise the capital to pay the defendants 30% share of the equity and save her family home.
