Julius Nkafu represented and successfully stopped the removal of a client who had been denied entry upon arrival at Heathrow airport on the basis that the Immigration officer was satisfied that the COVID 19 test results certificate produced by him was falsified and/or counterfeit.
Julius challenged the decision and the basis upon which the officer could be satisfied, without evidence. The decision to refuse entry was therefore unlawful. Further, Julius could demonstrate that the certificate was in fact authentic. The client was released, and his visa reinstated.
A person arriving from outside the common travel area, in accordance with The Health Protection (Coronavirus, International Travel)(England) Regulation 2020, is required to produce a document on arrival in the UK as proof that she/he holds a valid negative coronavirus (COVID-19) test result obtained within the last 72 hours.
As a result of the increase in the reported cases of fake COVID-19 certificates being used, authorities check the authenticity of certificates and will ask the bearers questions about how they obtained the certificates and/or contact the providers of the certificates. It is therefore safer to obtain certificates from known designated test centres, instead of using third parties.
