Kevin Metzger, instructed by Sadia Mahmood and Mohammed Naser of M & N Solicitors, Birmingham, secured an acquittal on one count of attempted kidnap for his client at the Wolverhampton Crown court.
The case attracted local and national media interest as the prosecution alleged that the defendant had attempted to kidnap a baby from the neonatal ward of a Wolverhampton Hospital. The Crown posited that the defendant had lied to her husband about giving birth to twin boys, one of whom had died and that she sought to kidnap a baby to present as her own. The defence agreed that she had lied about giving birth but submitted that the defendant was a woman with a difficult and troubled background who felt trapped by her culture and social circumstances who had no intention of taking the baby girl to present as her own. The jury returned a not guilty verdict after 48 minutes of deliberation in a case that lasted 2 weeks.
