Vishal Misra, instructed by Jeannel Ambrose of Wainwright & Cummins solicitors, was successful in the Court of Appeal in an appeal against sentence.
The Appellant was only 20 years old and of previous good character. It had been suggested by probation that he would benefit from a community based sentence. Nevertheless, the Appellant was sentenced to 3.5 months immediate custody for possession of a small blade and possession of cannabis.
Vishal argued that the sentencing judge did not consider the factors which made the sentence suitable for being suspended. Vishal also argued that the sentencing judge did not pass a proper sentence for the possession of cannabis offence. The appeal was allowed.
The Appellant’s sentence was quashed and replaced with a term of 3.5 months, suspended for 12 months.
