Clarissa Rodio , instructed by Elena Jacobs of Coomber Rich, secured the discharge of her client’s extradition to Romania on the basis that the offences contained in the warrant and those contained in the further information do not meet the requirements of dual criminality.

The Requested Person was sought by Romania pursuant to a conviction warrant. In the period between 2013 and 2014, the Requested Person was convicted of joining an organised criminal group for the purpose of committing offences involving the trafficking of ethnobotanical products. A suspended sentence was imposed for a duration of 3 years, which was activated due to his conviction of a further offence of possession and supply of synthetic cannabinoids.

Clarissa argued that the chemical compounds specified in the further information were not controlled in this jurisdiction at the relevant time and the JA conceded that none of the offences are extradition offences.

The Requested Person’s discharge was ordered under section 10(3) of the Extradition Act 2003.
