Chengetai Mupara was successful in an appeal by an NHS gastroenterologist from Mongolia. The Home Office accepted that they had wrongly curtailed her leave when they unlawfully (without evidence) accused her of having cheated in order to obtain a TOEIC certificate at a previous appeal. The Home Office did not challenge the decision. When the client applied for settlement, the Home Office refused her application on the basis that the client was a TOEIC cheat.
Chengetai successfully argued that there was no basis to reopen the deception point as it was finally determined by the previous decision. The judge agreed and ruled that the client should be granted settlement.
