Richard Barrett, instructed by Montague Solicitors, secures the acquittal of his client following his successful submission of no case to answer at half time at Winchester Crown Court.

The defendant was charged with joint enterprise GBH on his wife’s ex-partner. The defendant was jointly indicted with his wife, accused of a vicious assault on her ex-partner, resulting in his receiving a fractured eye socket and a broken nose in an alleged unprovoked attack at their home address.

The Recorder upheld a defence submission under the first limb in R v. Galbraith. The prosecution were considering a separate count against each co-defendant when they realised that the defence submission may succeed. This proposed course of action was vigorously opposed by counsel for both co-defendants. Richard’s client was acquitted but the trial against his wife continues.
