Mahmud Aslam, instructed by Glaisyers Solicitors Birmingham, secures Not Guilty verdicts for his client charged with armed robbery and possession of a bladed article at Birmingham Crown Court.
The defendant, first on the indictment alongside two co-defendants, was alleged, in the early hours of the morning, to have entered a McDonalds near to Birmingham New Street Station and made homophobic remarks to the complainant and his partner who were at a self-service kiosk. Thereafter the complainant was threatened with a knife and compelled to purchase food for all three defendants, who had leant over him and tapped different items on the menu for themselves and grabbed the receipt and then gone to the counter and collected the food. The defence case was simply that no homophobic remarks had been made and no knife had been produced or shown and that the complainant, as an act of kindness, had purchased the food.
After cross examination of the complainant by the defence, the prosecution elected to offer no further evidence and formal verdicts of Not Guilty were entered in relation to all three defendants on both Counts.
