The Appellant appealed from the Upper Tribunal, which had set aside the First Tier Tribunal’s determination allowing her asylum claim. The Court of Appeal (Underhill LJ, Peter Jackson LJ and Whipple LJ) dismissed the Appellant’s six grounds of appeal, which challenged whether Albanian women (other than trafficking victims) are members of a particular social group under the Refugee Convention, humanitarian protection, risk on return, sufficiency of protection, internal relocation and very significant obstacles to integration under Article 8 ECHR. The Upper Tribunal had lawfully concluded that there was no risk, an in any event a sufficiency of protection, and internal relocation was available. The UT had also lawfully concluded there were no very significant obstacles to integration in Albania for a single mother with three children, one of whom was illegitimate and had been treated successfully in the UK for cancer.
