Amanda Jones, instructed by Sriharans Solicitors, represented the successful Appellant in the case of BI (Nigeria) v SSHD.
The Appellant, a single mother of an infant girl, applied for asylum on the grounds that she feared her family would, against her will, subject her baby daughter to Female Genital Mutilation (FGM) as had happened to her, her sisters, and her sisters’ daughters. The SSHD did not believe her.
The Judge accepted Miss Jones’ submissions that: (1) the Appellant fell within the social group of “parents of girls at risk from FGM”; (2) there was a well-founded fear of her family carrying FGM out against her will; (3) there was not a sufficiency of protection for the Appellant and her daughter; (4) it would be unduly harsh for the single mother and baby to relocate, without family, a support network, employment or protection elsewhere in Nigeria.
The appeal was allowed on asylum grounds and on human rights grounds under Article 3 of the EHCR.
