Our client was sentenced in 2007 to 1 year’s imprisonment and had a sentence of 9 months’ and 29 days remaining. He had been living in the UK since 2007. He had been extradited to Poland on a separate matter in 2017 and had returned to the UK immediately after serving that sentence. Crucially, the client was suffering from an array of complex medical conditions. In addition, by the time of the extradition hearing, he had served 5 and a half months in custody. Despite the fact that the District Judge found the client to be a “fugitive”, he concluded that extradition would not be compatible with the client’s article 8 rights.
Our client was discharged and released from custody.
