Ania Grudzinska, instructed by Rochelle Dennie of Saunders solicitors, secures the discharge of an extradition warrant sought by the Regional Court in Gdansk, Poland in relation to offences of domestic violence against his ex wife.
The Requested Person received a 1 year and 6 month suspended sentence but did not comply with the obligations imposed in relation to it. The suspended sentence was activated and the RP was required to surrender to prison in Poland. He became “unlawfully at large” in 2007 however he moved to the UK in 2005 and undertook various jobs since. He had suffered from alcoholism which resulted in the commission of various acquisitive crimes in the UK. The RP has since entirely rehabilitated himself. He has been helping his daughter to care for her two young children.
The District Judge found that on the one hand: the RP is a fugitive, the offences were not trivial, a significant sentence remains to be served in Poland and that he had not led a blameless life in the UK. On the other hand, the Judge found that: the RP has lived and worked in the UK for a number of years now, he has not committed an offence in the UK since 2010, he has turned his life around and combatted his alcoholism, he has a daughter and grandchildren in the UK who rely upon him for support and the offences are now nearly 25 years old and there has been some culpably delay on the part of the Judicial Authority. On that basis, the Judge found that there would be a disproportionate interference with the RP’s article 8 rights to order his extradition and, therefore, ordered his discharge.
