Brereton Horne secures Not Guilty verdict for his client charged with robbery

Brereton’s client was one of two defendants who stood trial. Another defendant had pleaded guilty at an earlier stage in the proceedings. From the outset, the complainant in the case did not provide a statement to the police and he subsequently refused to engage with the process. The prosecution proceeded without a complainant solely on the premise of rea gestae in relation to 999 calls and hearsay pertaining to police body worn video footage, on which the complainant was recorded at the scene giving an account to the police.

Following successful protracted legal arguments from Brereton over two days, the Prosecution had no choice but to offer no evidence against the defendants and the judge entered verdicts of not guilty.
