Brereton Horne, instructed by Mohammed Naser f M & N Solicitors, secured the acquittal of a man who was arrested for attempted murder and tried with three other defendants for Conspiracy to cause Grievous Bodily Harm with Intent (s18).
The allegation for which the defendant was tried occurred in August 2018. The trial was fixed to last 7 days at Birmingham crown Court, however, on the third day of trial, part way through the case of the prosecution, the defence collectively opposed an application by the prosecution to rectify telephone evidence which was crucial to their case. The Judge refused the prosecution’s application and as a consequence the prosecution offered no evidence against all defendants. The jury were instructed to return verdicts of not guilty.
