Chengetai Mupara, instructed by IPS Legal, was successful in an appeal by an Eritrean national.
He failed to apply to extend his leave to remain as a spouse on time. The Home Office refused his application and decided that he should leave the UK and apply from abroad.
Chengetai successfully argued that it would be disproportionate to require the client to return to Eritrea. There is a risk of being stopped at check points in Eritrea. If a foreign connection is established, the client would be required to pay 2% tax, failure of which, ghastly consequences could follow.
The judge allowed the appeal on the spot.
