Chengetai Mupara (https://www.linkedin.com/company/18837980/admin/?share=true) has been successful in an application for judicial review against the Secretary of State for the Home Department.
His client applied to renew his leave to remain in the UK in January 2013. The application remains pending. Chengetai argued that the Home Secretary’s failure to decide the application is unlawful as delay is based on the Home Secretary’s mistaken belief that the client was involved in war crimes and crimes against humanity in his country of origin. The Home Secretary conceded and undertook to decide the application in three months.
