Lucy Chapman, instructed by the Royal College of Nursing – Company, obtains interim order revocation for midwife.
Lucy’s client was an independent midwife involved in the complex delivery of a baby, which later tragically died. It was alleged that the registrant midwife’s clinical failings contributed to the death. The registrant denied the allegations.
The midwife was initially made subject to a stringent interim conditions of practice order which effectively prevented her from continuing her business or practising in her area of specialism.
Lucy took on the case at the point of the early review of that order. She argued, successfully, that there was no cogent evidence in support of half of the regulatory concerns. Further, as to the remaining concerns, there was no real risk to the public which justified the order continuing.
Lucy’s client was able to resume her career unrestricted whilst the regulator’s investigation continued.
