Lucy Chapman, instructed by The Royal College Of Nursing Of The United Kingdom, successfully defends her client, a nurse facing charges of bullying and discrimination
Lucy defended a nurse registrant in a senior clinical governance role, accused of wide ranging bullying behaviour, including racist, discriminatory and antisemitic remarks towards multiple colleagues, and discriminatory remarks against a transgender colleague. The registrant’s case was one of bad faith, that she had been scapegoated by the trust for a negative CQC report, faced repercussions for raising safety concerns vocally, and was discriminated against for being the only Asian member of the senior management team.
Following Lucy’s skilful cross examination of six of the trust’s complainant witnesses, she mounted a successful submission of no case to answer on the prospects of misconduct being found proved for several charges. Of the remaining charges, the majority, and most serious, were not proven. Of the charges proved, Lucy successfully argued that her client’s fitness to practise was not currently impaired.
