Mahmud Aslam, instructed by Barry Linnane of JD Spicer Zeb Solicitors, secured unanimous acquittals on two counts of Rape and Sexual Assault, following a four-day trial at Harrow Crown Court.

The defendant, at a house party, was alleged, to have initially sexually assaulted one complainant in a locked bathroom and shortly thereafter enter a bedroom and rape a second complainant who was asleep on a single bed. The second complainant alleged that she awoke whilst the defendant was raping her. The defendant denied that any sexual assault had taken place in the locked bathroom. Whilst accepting that he had entered the bedroom and laid next to the second complainant, who was asleep, he maintained that any activity that took place thereafter was consensual and initiated by the complainant who may have believed he was someone else. The defendant maintained that the complainant had encouraged him amongst other matters to use more force and “grab her throat and pull her hair”, which the complainant had denied. The jury returned unanimous verdicts of Not Guilty in relation to both counts.
