Our client was wanted for an offence which, on the face of it, was the result of the police enticing him to Poland to pay a ransom for the release of his brother from people traffickers. The traffickers were police officers. Of itself this is an abuse of process however, the DJ found that the extradition would be oppressive by reason of the passage of time and the warrant was discharged. The delay in the issue of the EAW was unexplained and amounted to over 7 years.
