Nick Beechey, instructed by Gavin Rose of Wells Burcombe Solicitors, succeeded in having his client’s sentence of imprisonment for public protection (IPP) quashed in the Court of Appeal. Neither Nick nor Gavin were instructed in the court below.

In a worrying case, in which the appellant had served some 8 years or more over tariff, Nick persuaded the court that the judge had been wrong in law to impose an IPP. Allowing the appeal and an application for an extension of time of over 11 years, the court substituted the IPP for a 3 year determinate sentence (which has long since been served).
