Nick Beechey, instructed by Gavin Rose of Wells Burcombe Solicitors (neither of whom represented the applicant in the lower court) appeared in the Court of Appeal (Criminal Division) on a renewed application for leave to appeal sentence and an extension of time in which to do so, leave having been refused by the Single Judge.
The sole issue on appeal was that the sentencing judge, in imposing consecutive sentences, failed to make any allowance for the principle of totality, and as a consequence the sentence was manifestly excessive. The applications and the appeal were allowed, and the total custodial term was reduced from five years to four years.
