Poppy Cleary and Harry Piercy, instructed by Cotisens Solicitors, have successfully secured the dismissal of the case against their client following a submission of no case to answer at Basildon Crown Court.
The defendant faced a charge of attempted domestic burglary and the prospect of being sentenced as a “third striker” if convicted. The prosecution relied on cell site evidence placing the defendant in the same town shortly after the alleged offence, telephone contact between the defendant and a co-defendant, and CCTV footage said to show a resemblance between the defendant and one of the suspects.
Poppy and Harry each prepared detailed written submissions, which were developed further by Harry in oral argument. They successfully contended that the prosecution’s evidence was so weak that no reasonable jury, properly directed, could safely convict.
The trial will continue against the remaining two defendants.
