Vishal Misra, instructed by James Matfin of John Black Solicitors, has secured the acquittal of his client on all counts following a 9-day trial at Manchester Crown Court.
The allegations were grave and extensive, comprising: 1 count of assault by penetration, 4 counts of rape, 4 counts of strangulation and 2 counts of assault occasioning actual bodily harm.
Throughout the trial, Vishal undertook a meticulous and forensic examination of the prosecution’s unused material. This careful analysis revealed a narrative that stood in stark contrast to the complainant’s account as presented in evidence. During cross-examination, Vishal tested the complainant’s evidence against this unused material, exposing significant inconsistencies and evidential gaps. The jury heard evidence concerning the complainant’s lack of full openness with social services, her own propensity for violence, and the fact that she had initiated and maintained constant contact with the defendant while he was on bail.
After approximately 8 hours of deliberation, the jury returned unanimous not guilty verdicts on all 11 counts.
