Zakir first represented the client at the Upper Tribunal at Field House and successfully argued that the matter should be remitted back to the First-tier tribunal as the Secretary State had failed to discharge his burden of proof and the immigration judge made an error of law.
In the First-tier tribunal Zakir was able to argue that the client’s credibility about the domestic violence, and her inability to care for herself in India as a single woman being forced to relocate would put her at a real risk if she returned to India. The client was found wanting on the point of using deception in the ETS/TOIEC matter at the hearing, however her asylum claim and credibility was not undermined.
Zakir successfully argued that the client’s removal from the UK will breach the 1951 Geneva Conventions.
