Brereton Horne, instructed by Musa Audu of Audu & Co, secured the acquittal of his client who faced an indictment containing two counts of Wounding With Intent To Cause Grievous Bodily Harm, contrary to section 18 of the Offences Against The Person Act 1861; and the alternative count of Unlawful Wounding, contrary to section 20 of the Offences Against The Person Act 1861 .
The prosecution alleged that the 56 year old defendant stabbed the complainant, her then partner, in the back of his left shoulder with a knife, thus causing the injury which he sustained. Brereton addressed the jury on the lack of credibility of the complainant and submitted to them that, on the basis of the evidence before them, they couldn’t be sure that the wound was caused by his client. The jury, which was reduced to 10, returned majority verdicts (9-1) of not guilty.
