Chengetai Mupara is successful in an application of indefinite leave to remain, instructed under the public access scheme.
The Home Office took several years to decide the client’s application. Chengetai initially challenged the delay by way of judicial review. The Home Office conceded and agreed to consider the application within three months. Chengetai then argued that the Home Secretary should exercise her discretion and grant indefinite leave to remain instead of another period of limited leave as the delay was unlawful and an example of (shocking) maladministration.
