Chengetai Mupara, instructed by Louis Kennedy Solicitors, successfully defended a market trader in a personal injury trial.

The claimant brought a personal injury claim after visiting a busy morning market. She claimed that she suffered an injury as a result of the defendants’ negligence and/or breach of a statutory duty and that the injury caused her loss and damage. Chengetai’s client maintained from the outset that the claim was fabricated. He was prevented from giving witness evidence after he failed to filed his witness statement on time as a litigant in person. His application for relief from sanctions was unsuccessful.

Chengetai and co-defendant’s counsel cross-examined the Claimant and the Judge found the Claimant to be evasive and to have given false and misleading evidence. The Judge found a large portion of her claim to be fundamentally dishonest.

The claims were dismissed with costs ordered.
