Dan Santos-Costa, instructed by Simon Bethel Solicitors, secured the acquittal of a defendant charged with assaulting an emergency worker at Bexley Magistrates’ Court.
It was alleged that the defendant had kicked out at a police officer, striking her on the shin multiple times. The defendant, when giving evidence in chief, spoke about the pain he was in at the relevant time as a result of a medical condition. Dan submitted that the defendant’s mental state at the time of the alleged offence was entirely consumed by the pain he felt, so much so that he could not have formed the required foresight to be found guilty of recklessly assaulting an emergency worker. The Lay Bench found the defendant not guilty.
