Ania Grudzinska, instructed by Hollingsworth Edwards, secures the discharge of an extradition warrant in relation to Article 8 of the ECHR.
District Judge Mcgarva refused to order the extradition of the Requested Person (“RP”) to Poland to serve a sentence of 10 months’ imprisonment in relation to offences of assault and child neglect committed in 2014. Despite a finding that the RP was a fugitive and that the conduct was not trivial, the Judge nonetheless found that extradition would be a disproportionate interference with the RP’s Article 8 rights. The warrant was discharged.
