Dominic Bardill, instructed by Samuel & Co Solicitors on a private basis, secures the acquittal of his client on a 13 count indictment including 4 counts of rape, 2 of controlling and coercive behaviour, 2 of strangulation and administering noxious substances.

The complainant alleged that the defendant had violently raped her on multiple occasions. Furthermore, the complainant alleged that the defendant had drugged her to the point of unconsciousness, strangled her to the point of collapse, beaten her, controlled her finances, movement and day to day life. She alleged that this behaviour was repeated on multiple occasions over a period of time. As a consequence, the defendant potentially faced life imprisonment.

Dominic robustly advanced a defence of consent and fabrication. He cross-examined the complainant over 2 days and through detailed questioning of the complainant and Crown’s witnesses (including the officer in the case), he exposed inconsistencies and untruths. Dominic’s forensic scrutiny of the evidence, exposed failures in the police investigation and argued that the evidence was fabricated and tampered with and the allegations falsified.

After a 9 day trial at St Albans Crown Court, the jury returned unanimous Not Guilty verdicts on all counts, preserving the defendant’s good character and securing his release from custody.
