Jeanette Stevenson instructed by Cotisens Solicitors, was instructed by the defence to represent a defendant charged with ABH against his ex partner in the early hours of new years day 2021. The complainant had never provided a statement to the police to complain about being assaulted. The Crown relied solely on body worn evidence obtained by the police when responding to the initial 999 call. There had been no witness to any alleged assault and no medical evidence served.

Jeanette submitted that, not only was there no credible evidence of an assault having taken place, but the defendant would not receive a fair trial if the evidence obtained on the body worn evidence could not be tested under cross examination. The issue was one of self-defence. The defendant was of good character. Today at Wood Green Crown Court, the Prosecution formally offered no evidence to the charge and the Judge returned a Not Guilty verdict.
