Lucy Chapman, instructed by the United Kingdom Council for Psychotherapy (“UKCP”), represented the Council in the first appeal brought by it under its rules. The Council were appealing an unduly lenient sanction imposed by its Fitness to Practise Committee, which had previously imposed a conditions of practice order against a psychotherapist registrant for a case of sexual misconduct. The registrant argued that the indicative sanction guidance (“ISG”) imposed a requirement of exceptionality in cases of sexual misconduct in order to depart from a sanction of removal from the register, which was not lawful.
Lucy successfully argued that the ISG was not contrary to the principles of proportionality and right touch regulation, and that the sanction imposed was unduly lenient in the circumstances, securing a strike off.
