Mahmud Aslam, instructed privately by Barry Linnane of JD Spicer Zeb Solicitors, secured an acquittal on one count of Sexual Assault.
Following an initial five-day trial at Stafford Crown Court, resulting in a hung jury, the complainant indicated shortly before the retrial that she was no longer willing to support any further Prosecution.
The defendant, who was of good character, single and a “highflyer” with lucrative employment in the city, was alleged to have sexually assaulted the complainant (an actress) during a late three-hour rail journey. It was alleged that the defendant had instigated intimate and detailed explicit sexual conversations with the complainant and then proceeded to sexually assault her during the journey.
The defendant, whilst accepting the nature of the explicit sexual conversations, maintained that the complainant was an active participant both in the conversations and the physical activity that took place.
A formal verdict of Not Guilty was entered.
