Mark Robinson, instructed by Wainwright & Cummins Solicitors LLP, secures an acquittal for his client charged with one count of sexual assault after a 3 day trial at Isleworth Crown Court.

The defendant was accused of groping his work colleague’s buttocks and attempting to squeeze her breast in the staff kitchen at lunchtime. The defendant had worked for the company for 42 years before the allegation.

The Crown relied on the accounts of the complainant, one eyewitness and two managers that dealt with the internal investigation. During the trial, and despite the two managers being prosecution witnesses, they both gave evidence that severely damaged the Crown’s case and completely undermined the creditability of the complainant, who had previously been given a written warning regarding a complaint, where she had communicated information concerning another alleged sexual assault on a colleague that turned out to be a mistake. The managers supported the defendant’s character and his 42-year employment record. He was never the subject of a complaint or disciplinary.

The trial had to be paused several times for the jury to leave court as more evidence was adduced by the prosecution witnesses, which further damaged the Crown’s case. However, despite Mark’s best efforts, the trial Judge ruled against the admissibility of the witnesses’ evidence and the case was allowed to continue.

In Mark’s closing speech he made submissions about the defendant’s impeccable character, the prosecution witnesses that supported the defence case, the credibility of the complainant and eyewitnesses and the inconsistencies in both their statements.

The jury took just 14 minutes before returning a unanimous not guilty verdict.
