Mark Robinson, instructed by Don Solicitors, and Vishal Misra, instructed by Gordon Shine Solicitors, successfully secured acquittals for their clients at Highbury Youth Court.
Their clients, 15 and 16-year-old brothers, were charged with Actual Bodily Harm as part of a joint enterprise that involved two other defendants, where the victim was stabbed in Westfield Shopping City in Shepherd’s Bush, West London. Mark and Vishal made reference to R v Jogee (2016) and submitted that their clients were not part of a common purpose to inflict harm on the victim, and relying on self-defence, further submitted that both defendants’ actions were necessary and proportionate. The Court agreed with their submissions and acquitted them both.
