Nasreen Shah, instructed by IBB Law, was successful for her client, charged with burglary, in opposing an application to adjourn by the Crown, ending in the dismissal of the case against her client.
The Crown had failed to disclose any of the evidence central to their case, including CCTV and DNA evidence. Nasreen challenged the Crown on their failure to comply with any disclosure requirements, continuity of the evidence and inability of the defence to properly challenge any case at a future juncture without incurring further significant delays. The client would have effectively been deprived of a fair trial. It was held that it was not in the public interest for the adjournment to be granted, following which, the Crown offered no evidence, and the case was dismissed.
