Nick Beechey, instructed by Gavin Rose of Wells Burcombe Solicitors (neither of whom appeared in the Court below), succeeded in the Court of Appeal on a reference from the CCRC (subsequent to Nick drafting an application to the CCRC) in having the appellant’s 7 year old conviction (on a guilty plea) for a s6 Bail Act failure to surrender offence quashed, and in an appeal against sentence imposed in relation to a number of substantive offences. The Bail Act conviction was quashed on the ground that the Crown Court did not have jurisdiction to try the offence, as the appellant was an extradited person and the conditions in s150 of the Extradition Act 2003 were not satisfied. The consecutive sentence that had been imposed for the Bail Act offence falls away as a consequence. The appeal against sentence related to the failure of the sentencing judge to direct that days spent on a qualifying curfew count towards the time served on the 15 year custodial sentence, imposed 7 years ago.
