Nick Beechey, instructed by Gavin Rose of Wells Burcombe Solicitors, neither of whom appeared in the lower court, has succeeded in persuading the Court of Appeal Criminal Division to extend time to appeal and to quash a sentence of imprisonment for public protection (IPP) imposed in 2010 for an offence of attempted rape (a serious case involving an attack on a stranger after dark, with threats to kill).
The grounds of appeal were that the sentencing judge had failed to consider the availability of an extended sentence as an alternative to an IPP and that the judge was wrong in principle to impose an IPP rather than an extended sentence,. The court substituted an extended sentence comprising 6 years’ custody together with a 5-year extended licence period, a sentence that has now expired.
