Rushnay Sikander, instructed by The Johnson Partnership Solicitors, secured multiple acquittals for her client charged with Threats to Kill, Suffocation, ABH and Assault by Beating following a 4-day trial at Nottingham Crown Court.
The allegations arose in a domestic relationship between the parties during the currency of a Restraining Order against the defendant.
On instructions, Rushnay challenged the credibility of the allegations, the complainant’s character and the motivation behind her retraction statement. This led to a large amount of the defendant’s bad character being adduced at trial including a recent previous conviction of ABH against the complainant as well as multiple, serious previous convictions of violence against other ex-partners.
In order to counter this, the jury heard evidence of text messages between the parties where it was put to the complainant that her intention was the entrap the defendant.
After hearing all the evidence, the jury returned unanimous not guilty verdicts within 45 minutes.
