Shoba Aziz , instructed by Rashid & Rashid Solicitors, is successful in a complex human rights appeal which has been allowed on Article 3 medical grounds and Article 8.
The appeal was originally dismissed in 2020. The matter was successfully appealed by Shoba to the First Tier Tribunal. The appeal was remitted to be heard a fresh in 2021.
The Appeal concerned an Albanian national who came to the UK clandestinely in 2016. He suffered from many medical and mental health issues which exacerbated over the years. He was in need of family support and medical care which he received in the UK. Many witnesses and professionals gave evidence in the Appellants favour. Shoba submitted that the Appellant would not be able to access the treatment and therapy he is currently receiving in the UK which would cause him intense suffering and breach Article 3 ECHR.
The Judge accepted that the Appellant had severe, enduring health problems and found the witnesses credible. It was also found that the Appellant would not be able to access the medical treatment he needed in Albania and was in need of family support which he would not receive in Albania. The appeal was allowed.
