Shoba Aziz, instructed by Anglia Immigration Law, was successful in an EUSS Appendix EU appeal.
The Appellant made an application to join her spouse in the U.K as a family member of an EEA citizen. The ECO concluded that the marriage between the parties was not genuine and refused the application. The matter came to court and Shoba was instructed to prepare detailed written submissions before the hearing. She argued orally in court that the ECO had not discharged the burden of proof to show that the Appellants marriage was not genuine. She made reference to evidence and case law and convinced the Judge to accept the marriage as genuine and for the Appellant’s appeal to be allowed.
The Judge accepted that the Appellant had a genuine marriage and the appellant should be granted a EUSS family permit to join the sponsor in the U.K. The judge also made a full fee award in favour of the appellant.
