Following a 5-day trial at Inner London Crown Court, Vishal Misra, instructed by Umar Zaheer of BKP Solicitors, successfully secured the acquittal of his client on all counts.
The defendant initially faced allegations of false imprisonment, non-fatal strangulation, and assault by beating. Vishal successfully submitted that there was no case to answer in respect of the non-fatal strangulation charge, arguing that there was no evidence of strangulation and that the facts, at their highest, amounted only to assault by beating. Vishal also made a successful bad character application relating to the complainant. Following extensive cross-examination, significant inconsistencies in the complainant’s account were exposed. He further submitted that there was minimal evidence to support the allegation of false imprisonment and that the complainant’s account was not possible given the physical layout of the defendant’s flat.
The jury returned unanimous not guilty verdicts on all three counts.
