Approved Judgement in SS v MCP [2021] EWHC 2898 (Fam)
Ann Tayo, instructed by Dr Juliet D’Souza of IEC Solicitors, made an application on behalf of the father (following a determination from The European Court of Justice in respect of it’s interpretation of Article 10 of Brussels 2 bis Regulation) to the High Court for it to invoke its inherent parens patrae jurisdiction in a case of child abduction. The child was wrongfully removed from the care of her father by her mother (from the UK) when it was still a member of the European Union, and taken to India to be raised by her 70 year old grandmother in a non European Union Member State and Non Hague Convention Country.
