Mark Robinson, instructed privately by SM Solicitors, represented a client in relation to the suspension of his client’s PCV licence at the Public Inquiry Room tribunal.

The client was a former bus driver for Stagecoach, who referred him to the Office of the Traffic Commissioner after CCTV in his cab showed him using his mobile phone and speeding. Stagecoach also stated that the client had a collision. Upon a full finding against the client his PCV licence would be revoked.

Mark submitted that his client had an impeccable 14-year driving record thus far and had received awards from his company for being accident free. The mobile phone was only used to play music whilst the bus was not in service and the speeding occurred whilst his client attempted to remedy a fault with the air suspension that he had reported at the start of his shift. Stagecoach had failed to provide any evidence of a collision.

The Commissioner agreed with Mark’s submissions and imposed the minimum disqualification period for use of a phone whilst driving.
